Injury Cases Have Strict Deadlines

California injury claims are governed by strict legal deadlines. Important evidence can also be lost if a case is not investigated early.

Insurance companies often continue “investigating” or “negotiating” while deadlines are quietly approaching. Once a legal deadline passes, your case may become worthless — even if the insurance company was still communicating with you when the deadline passed.

Part of my job is making sure deadlines are identified, evidence is preserved, and your rights are protected from the start — so you’re not pressured into a decision before you understand your options.

If you’re unsure what time limits apply to your situation, a free, no-pressure consultation can help clarify your options.

Types of Motor Vehicle Crash Cases I Handle

Motor vehicle collisions can happen in many different ways. I represent injured people in cases involving:

Car Accidents

Rear-end, side-impact, head-on, and multi-vehicle crashes on streets and freeways.

Motorcycle Crashes

Crashes caused by unsafe lane changes, failure to yield, or drivers who fail to see motorcyclists.

Truck Collisions

Crashes involving delivery trucks and commercial vehicles, often with serious injuries.

Pedestrian Accidents

Crosswalk crashes, left-turn impacts, and cases where drivers fail to keep a proper lookout.

Bicycle Crashes

Unsafe passing, dooring, failure to yield, and dangerous intersections.

Uber & Lyft Accidents

Rideshare cases can involve multiple insurance policies and coverage disputes.

What to Do After a Motor Vehicle Collision

These steps can help protect your rights and your claim.

  1. Get medical care
If you’re in pain, it’s important to see a medical provider for diagnosis, treatment, and documentation of your injuries. Even crashes that insurance companies describe as “minor” can cause serious injuries.
  2. Photograph the scene
If you are able to do so safely, take photographs of the crash scene showing vehicle damage, vehicle positions, license plates, skid marks, road conditions, and traffic signals or signs.
  3. Exchange information
Obtain the names of all drivers and passengers, insurance information, vehicle registration details, and the names and contact information of any witnesses. Taking photographs of driver’s licenses, insurance cards, and registrations is often the easiest way to do this.
  4. Report the crash
If you are injured or experiencing pain, you should report the crash and request a police report. Officers may not always respond to non-injury collisions, but pain is an injury, and a report can help document what happened.

Important Warning: Signing Insurance Company Documents

Insurance companies sometimes contact injured people very quickly — sometimes the same day or within days of a collision — and ask them to sign paperwork. This is often an attempt to settle the case for far less than it is worth before you understand the full extent of your injuries or have a chance to speak with a lawyer.

Once you sign a release or settlement agreement, your case is usually over — even if your injuries turn out to be worse than expected. Do not sign any documents related to an injury claim until you’ve spoken with an attorney who can explain what you’re giving up.

A Quick Note About Calls With Insurance Companies

Insurance adjusters protect the insurance company — not you. If you’re asked for a recorded statement, it’s almost always better to speak to an attorney first so you better understand your rights.

Car Crash Q&A

Clear answers to common questions people have after a car crash.

I want an attorney, but I don’t have money for one. What can I do?

I work on a contingency fee. That means you never pay anything upfront — including fees or costs — and you do not owe attorney’s fees unless money is recovered in your case. If there is no recovery, you do not owe me a fee.

Do I need an attorney for a car crash?

Insurance companies are not on your side. Their goal is to pay as little as possible, and they often do that by twisting statements, minimizing injuries, and pushing quick settlements before you understand the full impact of the crash. An attorney protects you from these tactics and makes sure you are treated fairly.

What if I don’t have health insurance or I can’t afford medical treatment?

In some situations, medical providers may offer treatment on a lien basis. A lien is a contract stating that the provider will be paid from any recovery in your case, and that you remain responsible for the bill regardless of the outcome. This means that if you lose your case, you must still pay the medical provider.

What if I don’t have a driver’s license?

Not having a driver’s license does not automatically prevent you from making a claim after a car crash. Insurance claims focus on who caused the collision and whether you were injured. However, the lack of a license can complicate a claim, which is why it’s important to contact a personal injury attorney.

What if the other driver doesn’t have insurance?

Even if the at-fault driver does not have insurance, you may still have options through your own policy, including uninsured motorist (UM) coverage. Many people are unaware they have this coverage, and insurance companies do not always explain it clearly. An attorney can help determine what coverage applies and how to pursue a claim.

What type of damages can I recover in a car crash case?

In a car crash case, damages may include medical expenses, lost income, vehicle repair or replacement costs, and compensation for pain, suffering, and the impact the injuries have on your life. The specific damages available depend on the facts of your case.

How much is my case worth?

It depends on a number of factors, including your injuries, medical treatment, lost income, how the injury affects your life, and whether we can prove negligence. A consultation can help you get realistic guidance.

If I am an undocumented immigrant, can I make a personal injury claim?

Yes. Undocumented immigrants can pursue personal injury claims. Immigration status is not a defense to negligence, and the parties in the case generally cannot use the lawsuit as a way to inquire into immigration status.

What if I cannot travel to your Van Nuys office to sign up?

That’s not a problem. Most clients sign up remotely. We can review your situation by phone or video, and documents can be sent for electronic signature so you can retain our office without traveling.
